Police Log: Jan. 2 through 5

This is a summary of reports provided to JohnstonPatch by the Johnston Police Department for Jan. 2 through 5, 2012. Where an arrest is reported, it does not indicate a conviction.

False prescription arrest:

charged Thomas Kimberley, 40, of 3 Celebration Way, with felony counts of using a fake prescription to obtain drugs and conspiracy to violate the controlled substance act on Jan. 5 following an investigation into false prescriptions being used at the CVS pharmacy at 1400 Hartford Ave.

Ptlm. Mario Mennella reported that he went to the CVS on Dec. 16 to investigate a report of fake prescriptions. In the course of his investigation, Mennella said he learned that Kimberley had allegedly submitted 11 prescriptions for hydrocodone (Vicodin) over the course of the year.

The pharmacist told Mennella that she had checked with the doctor's office listed on the prescription and learned that Kimberley had never been a patient there, Mennella reported.

Later that same day, the pharmacist called Mennella to report that a female had called the CVS claiming to represent the doctor's office shown on the fake prescription.

On Dec. 22, another pharmacist from the CVS contacted Det. Robert Lemieux to report that Kimberley had used the store's automated voice system to renew a valid prescription for Chantix, and on Dec. 29, Lemieux reported, the pharmacy dispensed prescriptions for Vicodin, Chantix, and cefprozil (Cefzil) to a woman who shared Kimberley's address.

Lemieux reported that after he called Kimberley on Jan. 5, Kimberley reported to police headquarters. According to Lemieux's report, Kimberley allegedly admitted that he and a Smithfield man had agreed to file the fake prescriptions and divide the pills between them.

Police transported Kimberley to Third District Court in Warwick that day for arraignment. Judge Joseph T. Houlihan set bail at $5,000 personal recognizance and scheduled a felony screening conference for March 8.

Reckless driving warrant:

Neftali Bruno, 24, of Hartford, CT, was remanded to the Adult Correctional Institutions in Cranston on Jan. 4 after Ptlm. Joseph Salvadore reportedly caught him speeding on Hartford Avenue.

According to Salvadore reports, he clocked Bruno's vehicle at 45 mph in a 30-mph zone and found that the car's registration plates had been reported stolen by Hartford Police. The car, a 1990 Honda, was unregistered

Salvadore also reported that he found an outstanding warrant issued by Johnston Police for a Dec. 26, 2008 charge of reckless driving and eluding police.

Following his arrest on Jan. 4, Bruno was charged with misdemeanor counts of speeding, driving an unlicensed vehicle, driving with a suspended license, and misuse of registration plates, as well as a misdemeanor count of receiving stolen goods (the 1990 Honda) with a value less than $500.

Bruno could not post surety bail, and was held at Johnston Police headquarters until a court hearing the next day in Third District Court in Warwick.

At his court hearing, Bruno pleaded no contest to all charges. Judge Joseph Houlihan imposed fines and court costs totaling $892 and sentenced Bruno to two years' probation with two years' suspended.
